Appellant, Curtis Ray White, was tried for delivery of cocaine. Tex. Health & Safety Code Â§ 481.112. The jury assessed punishment at twenty-five years imprisonment. The Eighth Court of Appeals affirmed the conviction in an unpublished opinion. White v. State, 828 S.W.2d 15 (Tex. App.--El Paso, Sept. 19, 1990). We granted appellants petition for discretionary review, pursuant to Tex. R. App. Proc. 200(c)(3) and (4), in order to determine whether the court of appeals erred in holding that appellant was not harmed by the trial judges refusal to order a transcription of the States witness testimony from appellants first trial. We will reverse.
